Events Waiver

ASSUMPTION OF RISK

I _________________________, (Registrant's Name) HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN Victorious Faith Church, INC's (hereinafter VFC) Events and Services, including but not limited to any risk that might arise from negligence or carelessness on the part of the persons or entities being released, because of their possible liability without fault, through participation in this VFC event and/or future events held by VFC and not limited to outside events, but including events held inside a building of VFC as well.

I certify that I and any children in my custody or care are physically well and no qualified medical professional has advised me or any children in my custody or care to not participate or to stay home in quarantine or isolation. I certify that there are no health-related reasons or problems which preclude my or any children in my custody or care from participation in this activity, and or future events by VFC.

WAIVER AND RELEASE OF LIABILITY

A. I WAIVE, RELEASE, AND DISCHARGE, VFC and their directors, officers, employees, volunteers, representatives, and agents from any and all liability, including but not limited to, liability arising from negligence or fault of the agents of VFC or other participants of VFC Events and Services, for any real or perceived exposure to COVID-19, illness, death, disability, personal injury, property damage, or actions of any kind which hereafter occur to my child(ren) at any time including during our travel to and from this activity.

B. I INDEMNIFY, HOLD HARMLESS AND PROMISE NOT TO SUE the entities or persons mentioned in this Waiver and Release from Liability form from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise. I acknowledge that VFC is NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf and VFC is not responsible for any real or perceived exposure to COVID-19. I acknowledge that this activity may involve direct physical contact with individuals other than I and any children in my custody or care and my (our) immediate family and/or household members. 

I acknowledge that I am attending VFC Services of my own free will and VFC and their directors, officers, employees, volunteers, representatives, or agents did not force or compel me or any children in my custody or care to attend. I acknowledge that I (we) have been and will again be in public places, businesses, and in the presence of individuals other than those in my (our) household before and after this VFC event. 

In consideration of my participation in the event hosted by VFC, I hereby acknowledge and agree that VFC, its directors, employees, volunteers, or law enforcement personnel have the right, in their sole discretion, to remove, expel, or prevent the attendance of any individual(s) who, in their judgment, engage in disruptive behavior, pose a safety concern, or engage in disorderly conduct. To ensure the maintenance of a secure and well-organized environment, VFC and its authorized representatives reserve the right to employ any necessary force or measures. This waiver is a binding agreement, and I understand that by attending the event, I accept and consent to these terms.

AUTHORIZATION FOR THE USE OF COMMENTS AND PICTURES 

VFC is hereby authorized to take or permit pictures to be taken of me or any children in my custody or care for use by VFC in publications, newspapers, newsletters, its website, and/or on television for purposes of public relations for VFC. VFC shall also have the right to use any portion of any statement made by me or any children in my custody or care in any publication, newspaper, newsletter, or website. 

APPLICABLE OF LAW

This waiver and release of liability shall remain in effect for the duration of one calendar year. This Waiver and Release from Liability form shall also apply to all minors and persons in my (our) legal care, custody, and control attending VFC Events and Services. This Waiver Release from Liability shall be construed broadly to provide a release and waiver to the maximum extent permissible and governed by the laws of the Commonwealth of Kentucky and supersedes any and all previous oral or written promises or agreements. 

SEVERABILITY CLAUSE

I acknowledge this Waiver and Release is reasonable, valid, and enforceable. However, if any term, covenant, condition, or provision of this Waiver and Release is held by a court of competent jurisdiction to be invalid, void, or unenforceable, it is the intent of all parties that such provision is severable and the remainder of this Waiver and Release will in no way be affected, impaired, or invalidated as a result.

I CERTIFY THAT I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY FORM AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL.
